Trump’s Tariffs Found Illegal By U.S. Court, Restricting Presidential Power

 

U.S. kay federal appeals court ne faisla diya hai kay former President Donald Trump kay duniya bhar par lagaye gaye aksar tariffs ghair qanooni thy. Yeh faisla 7–4 kay majority se diya gaya, jis mein kaha gaya kay president ko emergency economic powers ka istamal karke dosre mulkon par aise baray tariffs lagane ka haq nahi tha. Court kay mutabiq, aise duties lagane ka haq Congress kay paas hai, na kay executive branch kay paas.

Yeh ruling un "reciprocal" tariffs par seedha asar dalti hai, jo Trump kay dauran China, Mexico aur Canada jaise mulkon par lagaye gaye thy. Trump ki administration ne in measures ko U.S. industries ki hifazat aur trade relations ko balance karne kay liye zaroori qarar diya tha lekin court ne inka qanooni base kamzor aur presidential powers se baahar paaya.

Halaanke court ne tariffs ko ghair qanooni qarar diya yeh abhi foran khatam nahi honge. Judges ne inhe 14 October tak barqarar rakhne ki ijaazat di hai, taake hukoomat ko mazeed review ka waqt mil sake. Is se yeh bhi mumkin hai kay Biden ki administration ya Trump ki legal team U.S. Supreme Court mein appeal file kar sake, jo is mamlay par aakhri faisla dega.

Yeh faisla trade policy aur U.S. mein powers ki taqseem kay liye bohat ahm hai. Is se Congress ki tariffs aur trade duties par qaboo ko mazid taqat milti hai, jabke presidential authority ko emergency laws kay tahat limit kiya jata hai.
